Hello. We sent a buyer in the USA expensive goods worth over 2,200 euros. After about four months, the buyer reported to their payment institution that the product was not as described. The money was initially blocked in the eBay account, and then after about 30 days it was returned to the buyer. The goods were not returned to us. We were harmed/scammed out of more than 2,200 euros. At this point, we are without money and without the goods. The buyer does not respond to messages in which we try to arrange for the goods to be returned to us. eBay is washing its hands of it, offering no help in recovering the goods or the money. Even after our requests, eBay does not intend to contact the buyer about this matter, claiming that it does not have such authority. We have no information about which institution took action to refund the buyer without any knowledge of the sold goods. I should add that we have evidence in the form of photos of the shipped products taken before packaging; the parcels are packed under camera surveillance. Is such a practice used by eBay and financial institutions legal? Is there a way to fight for the return of the goods or the money, e.g. in court? Do you have any ideas on how to prevent this?

·3 years agoI once read somewhere here that a seller tracked down the local sheriff's office and contacted them about a case similar to yours. Apparently, threatening the guy with the police helped, and he returned the money to the seller.

·3 years agoI had a similar case a few years ago. A customer from the UK bought a product from me for about 4000 PLN. He received the order and after a week filed a chargeback on PayPal. Of course the funds were immediately frozen by PayPal. I tracked the guy down in the UK and wrote to him that I had contacted the local police. It helped. He canceled the claim and PayPal refunded my money.

·3 years agoI experienced a similar situation some time ago, except that it was eBay that refunded the buyer without looking into the details.
After reading the posts on the eBay.com forum, I agree with the opinions there that eBay is too risky a platform to sell goods that you can't afford to lose.

OP3 years agoI’m going to try to consult a specialist in international commercial law about this.
This makes me wonder whether this practice of refunding money from our account without returning the goods is lawful. We are convinced that we delivered goods matching the description and were wronged out of a significant sum of money. It seems that any Buyer, even if they received the correct item, can always claim that the item is not as described and is guaranteed a refund at the Seller’s expense. In such a situation, the Seller cannot count on any help from Ebay. An unknown Financial Institution makes decisions about our goods and handles our refunds and money without having any knowledge of the products we sell. I believe this is very unfair and harmful to Sellers on this platform.
I’m wondering whether, in the event of trying to recover the goods or the money through the Court, the case should be brought against the Buyer, the Payment Institution, or Ebay.
